Following up on my post from July 23, here is an interesting view into the states’ reactions to the two court decisions on the legality of federal subsidies. The states aren’t waiting for the courts to decide whether millions of Americans will keep their subsidized coverage. But the question is, will states be able to leverage the federal technology and qualify as a state-run exchange? The answer to this question is important for employers, too, as they contemplate potential options for variable hour employees and/or pre-65 retirees, as well as the impact on employer shared responsibility assessments. This issue will likely take some time to work its way through the legal system.
